1. Overview
Welcome to Walking Canvas Co. (“we”, “us”, “our”). We operate this store and website, including all related information, content, features, tools, products, and services (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”) work together with our other posted policies (like Privacy, Shipping & Returns, and Refunds). By visiting or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you don’t agree, please don’t use the Services.
2. Access & Accounts
By using the Services, you confirm you’re the age of majority in your location (or have consent from a parent/guardian for minor dependents using devices you own or manage). You agree to provide current, complete, and accurate information (e.g., email, billing, shipping, payment). You’re responsible for safeguarding any account credentials and for all activity under your account. Accounts aren’t transferable or for resale.
3. Our Products (Made to Order)
We produce apparel on demand via trusted print partners. Minor variations in colour, print placement, or sizing may occur. We try to display products accurately, but colours/appearance may vary by device.
We don’t warrant that any item will meet every expectation; descriptions and pricing may change without notice. We may discontinue products at any time.
4. Orders
Placing an order is an offer to purchase. We may accept or decline at our discretion. An order is accepted when payment is received and processing begins.
Made-to-order cancellation window: If you need to cancel, contact us within 12 hours of purchase. Once printing starts, we can’t cancel or change the order.
Returns/exchanges are handled under our Refund & Returns Policy.
Purchases are for personal/household use, not for commercial resale or export.
5. Prices, Billing & Taxes
Prices are shown in your checkout currency and may change without notice.
Walking Canvas Co. operates as an Australian sole trader (ABN 57 579 046 013).
We are not registered for GST; no GST is charged on sales.
International customers are responsible for any customs duties, VAT, or import taxes set by their country.
You agree to keep your purchase and account information accurate and up to date.
6. Shipping & Delivery
All delivery windows are estimates, not guarantees. We’re not responsible for carrier delays, customs processing, or events outside our control. Title and risk of loss pass to you when the order is handed to the carrier. See our Shipping & Returns page for current timeframes and our flat-rate shipping details.
7. Intellectual Property
All content in the Services (text, logos, graphics, artwork, product designs, and images) is owned by Walking Canvas Co. or our licensors and protected by IP laws. You may not reproduce, distribute, modify, or create derivative works without prior written permission.
8. Optional Tools & Third-Party Services
We may provide access to third-party tools/services (including Shopify and Printify) “as is” and “as available”, without warranties. Use of any third-party service is at your own risk and subject to that provider’s terms.
9. Third-Party Links
Our Services may include links to third-party sites. We don’t control or endorse their content and aren’t liable for materials, websites, or transactions outside our store.
10. Relationship with Shopify
Our store runs on Shopify’s platform. Your purchases are made with Walking Canvas Co., not Shopify. By using the Services, you acknowledge Shopify isn’t responsible for sales between you and Walking Canvas Co., and you release Shopify from claims arising from those transactions.
11. Privacy
Your personal information is handled under our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes certain personal information. See our Privacy Policy for details.
12. Feedback
If you share ideas, suggestions, or feedback, you grant us a perpetual, worldwide, royalty-free, sublicensable licence to use them in any medium for any purpose. (No obligation to compensate or credit.)
13. Errors, Inaccuracies & Omissions
Occasionally the site may contain errors or omissions (e.g., descriptions, pricing, promotions, availability). We reserve the right to correct and update information without prior notice.
14. Prohibited Uses
Don’t use the Services for unlawful purposes; to infringe IP rights; to harass or harm; to transmit malware; or to spam/scrape. We may suspend or terminate access for violations.
15. Termination
We may terminate or suspend access at any time if you breach these Terms. You remain liable for amounts due up to the termination date.
16. Disclaimer of Warranties
Except as expressly stated by us or required by law, the Services and all products are provided “as is” and “as available”, without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, and non-infringement).
17. Limitation of Liability
To the fullest extent permitted by law, Walking Canvas Co. and our affiliates, employees, contractors, and licensors won’t be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the Services or products.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot be excluded. Where permitted, our liability is limited to the resupply of the Services or the replacement/refund of goods.
18. Indemnification
You agree to indemnify and hold harmless Walking Canvas Co., Shopify, and their affiliates/partners/employees from claims, damages, and expenses arising from your breach of these Terms or applicable laws.
19. Severability
If any provision is unenforceable, the remainder of the Terms continues in full force.
20. Waiver & Entire Agreement
These Terms (plus posted policies) are the entire agreement between you and Walking Canvas Co. and supersede prior understandings. Our failure to enforce a right isn’t a waiver of that right.
21. Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms at any time.
22. Governing Law
These Terms are governed by the laws of Australia, and you consent to jurisdiction in the courts of New South Wales.
23. Headings
Headings are for convenience only and don’t affect interpretation.
24. Changes to These Terms
We may update these Terms by posting a revised version on our site. It’s your responsibility to review them periodically. Continued use of the Services means you accept the changes.
